Terms and Conditions

1) Definitions

  • A reference to writing or written includes e-mails.
  • In these Conditions, the following definitions apply:
App Rewarding Visits' mobile application.
QR Code The QR code particular to you on the Card or on the App which may be used to scan in Retailer's stores or at a Retailer Rewarding Visits 'Touchpoint' screen ("Touchpoint Screen") and to earn or redeem Rewards in accordance with these Conditions.
Card A Rewarding Visits' branded card or a town centre card displaying the Rewarding Visits' logo.
Contract The contract between Rewarding Visits and you for use by the Individual of the Scheme in accordance with these Conditions which comes into effect on the date the individual registers with the scheme.
Individual, you, your The individual who has registered with the Scheme.
Retailer A retail entity who becomes a retailer member of the Scheme.
Rewarding Visits Rewarding Visits Limited registered in England and Wales with company number 8240602 and registered office 10 Wrens Court, 48 Victoria Road, Sutton Coldfield, West Midlands, B72 1SY.
Reward Any offer, promotion, voucher or other reward offered by a Retailer to any individual under the Scheme.
Scheme The scheme offered by Rewarding Visits under which individuals may obtain certain rewards or benefits from Retailers through scanning a QR Code on repeat visits to that Retailers store and Retailers record customer visits and may incentivise customers to return and visit through offering them Rewards.

2) Joining the Scheme

  • In order to use the Scheme you must first pre-register your account by:

    • if you have a Card, registering that Card online at rewardingvisits.com, at a Touchpoint Screen or by calling 08446696919;
    • if you download the App onto your mobile device, pre-register your account on the App or, where you have first registered your Card, logon to the App with your existing account details.
  • Rewarding Visits does not guarantee that your access to our Website, App or your account will be uninterrupted and error free.

  • The Contract shall come into effect on the date that you verify the email address you provided on registration by clicking the link on thee email that you receive from us after you have registered with the Scheme.

  • These Conditions apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.

  • Rewarding Visits will notify you using the email address you have provided on registration to provide you with notice of its intention to change these Conditions in the event that an amendment is required, including, without limitation, in order to comply with the law or otherwise in accordance with these Conditions and your continued use of the Scheme will constitute acceptance of such an amendment. If we do notify you of any changes to these Conditions you may contact us to end the Contract before the changes take effect.

  • You may only join the Scheme if you are a resident of the UK. Where you are under the age of 13, you may only join the Scheme if you have first obtained the consent of your parent or guardian. Where age restrictions are applied by law in respect of any Reward, you may only claim that Reward if you are the required age or over that age for example, you will not be entitled to claim any Rewards relating to alcoholic products unless you are over the age of 18.

  • Your right to use the Scheme is personal to you and neither your right to use the Scheme or any Rewards you receive under the Scheme are transferable.

  • The following additional terms also apply to your use of the Scheme:

    • Our privacy policy, available here, which sets out the terms on which we process any personal data we collect from you or that you provide to us (“Privacy Policy”). By using the Scheme, you consent to such processing and you warrant that all data provided by you is accurate;
    • In relation to your use of our App, our end user licence agreement (“EULA”) available here, which governs your use of the App and that you are supplied with and required to agree to before commencing use of the App; and
    • In relation to your use of our Website, our terms of use, available here, which govern your use (whether that includes accessing, browsing or registering to use) our website (“Terms of Use”).

3) Card

  • Your Card is provided to you by, and remains the property of, Rewarding Visits. Rewarding Visits reserves the right at all times in its absolute discretion and without notice to you to decide not to issue new Cards in the event that your Card is lost or destroyed.

  • Cards must be returned to us on request or destroyed when this Contract is terminated, for whatever reason.

4) App

  • The App is offered as part of the Scheme and is only available on compatible mobile phones and devices. You will need to own a Smartphone or other device which allows Apps to be downloaded with a connection to the internet and with either an iOS or Android operating system in order to download the App, register with the App and use the App. Your use of the App will be governed by these Conditions, the EULA and Privacy Policy.

  • The App will allow your compatible mobile device to display a QR Code.

  • To download the App visit here and follow the instructions on the site. You may only use the App in accordance with the EULA and must accept the EULA before you commence use of the App.

  • Rewarding Visits reserves the right to block you from using the App at its discretion in the event you do not comply with these Conditions or the EULA.

5) Rewarding Visits Rewards

  • You may only earn Rewards once you have successfully registered with the Scheme, as described in clause 2(a) above.

  • Rewards are provided to you at the Retailer’s discretion. All Rewards are subject to availability and may be subject to time limits in which they must be redeemed. If you do not redeem a Reward within the time stated, you may lose the right to redeem that Reward and that Reward will no longer be available to you. Although we make reasonable efforts to update the information on our Website and our App, we make no representations, warranties or guarantees, whether express or implied, that the content on our Website or our App is accurate, complete or up-to-date.

  • You can determine whether you have any Rewards available to you relating to a Retailer by visiting your account online at our Website, on the App or at a Touchpoint Screen or by scanning the QR Code with the relevant Retailer.

  • Where you have visited your account on our Website or our App, you can redeem any Rewards by adding such rewards to your “rewards basket” on your account and then by scanning your QR Code in the Retailer’s store, to which the Reward relates. Although you may add such rewards to the “rewards basket” on your account, you do not have to and you are also able to redeem any available Rewards with a Retailer by scanning your QR Code in that Retailer’s store.

  • Where you have visited a Touchpoint Screen, you can redeem any Rewards by printing a voucher in respect of a Relevant Retailer. In order to redeem the voucher, you must then present that voucher to the Retailer to which the Reward relates to allow the Retailer to scan the barcode on the voucher, where relevant.

  • Retailers may impose additional terms applicable to the redemption of a Reward and Rewards may be subject to the applicable legal rules or terms and conditions (including booking requirements, cancellation restrictions, return conditions, warranties and limitations of liability) of the relevant Retailer. Any additional terms applicable to a particular Reward will be stated on the page of the Website or the App on which the Reward is displayed.

  • Rewards cannot be exchanged for cash, as they have no cash value. Once redeemed the Rewards cannot be used again. Rewards can only be earned, held and redeemed by you as set out in these Conditions. Any Rewards obtained or used otherwise than in accordance with these Conditions will be invalid and cannot be redeemed.

  • If you lose your Card or if it ceases to work for any reason you may apply to Rewarding Visits and Rewarding Visits may, at its sole discretion, agree to replace your Card. You may apply your new Card to your account so that the Rewards applicable to your account will be available on your new Card. If you lose your mobile phone or the App ceases to work, the App can be re-downloaded and providing you logon with your original email address your Rewards will be available via your account on the new App, however Rewarding Visits will not be liable for any errors should the Rewards not be transferred.

  • Should you be in breach of these Conditions, or if we suspect that you are engaged in fraudulent or other criminal activities relating to use of your Card or App, or if you supply false or misleading information to us on registration of your account, or should we have any other reasonable objection to your continuing to collect Rewards via the Scheme, then Rewarding Visits may, on notifying you, forfeit all of your accrued Rewards, and/or suspend your right to collect and/or redeem Rewards and terminate your account.

  • You may automatically be sent email notifications of when a Reward has been added to your account. If you have downloaded the App and have accepted to receive push notifications, you may also be sent push notifications to advise you that Rewards have been added to your account. You may also receive email notifications from us about your current available Rewards.

  • Rewarding Visits’ reserves the right to vary, amend or withdraw any Retailer from the Scheme at any time without notice, in the event that that Retailer voluntarily withdraws from the Scheme or if Rewarding Visits’ separate agreement with the Retailer is terminated or expires for whatever reason.

6) Liability

  • Rewards are provided by Retailers and not by Rewarding Visits. Rewarding Visits has no obligation to provide Rewards under the Scheme to you and gives no guarantee that any Rewards will be made available to you. Rewarding Visits has no responsibility for the delivery, standard or quality of any Rewards or the failure of a Retailer to make a specific Reward available (whether before or after such Reward is redeemed by you). We will do our best to make sure the Rewards listed on our Website or our App are correct.

  • This Condition shall survive termination of the Contract.

7) Cancelling the Scheme

  • Rewarding Visits may close the Scheme at any time upon giving not less than one (1) weeks’ notice to you, including, in the event that there is an event outside its control, if we deem the Scheme to be not economically viable or if any Retailers pull out of the Scheme, in which event the Contract shall terminate upon the expiry of such notice. Without limiting its other rights or remedies, Rewarding Visits may terminate the Contract with immediate effect by giving notice to you if you:

    • commit a breach of any of your obligations under the Contract which is incapable of remedy or, fail to remedy where it is capable of remedy or persists in any breach of any of its obligations under the Contract after having been required in writing to remedy or desist from such breach within a period of fourteen (14) days;

    • have not earned or redeemed any Rewards for a period of at least 12 months.

  • You have the right to cancel your account at any time by contacting us at the details below. If you cancel your account you will lose the right to redeem all unused Rewards.

  • If this Contract is cancelled, for whatever reason, you will no longer receive any Rewards and all existing Rewards will be cancelled (and you will no longer have the right to redeem such Rewards).

8) General

  • Assignment: Rewarding Visits may transfer its rights and obligations under the Contract to another organisation, and it will always tell you in writing if this happens, but this will not affect your rights under the contract or the obligations owed to you under the Contract.

  • Entire Agreement: these Conditions together with the EULA, the Privacy Policy and the Terms of Use constitute the entire agreement between Rewarding Visits and you in respect of your use of the Scheme.

  • Waiver: If we fail to insist that you perform any of your obligations under these Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

  • Third parties: The Contract is between you and us. No other person shall have any rights to enforce any of its terms.

  • Variation: Except as set out in these Conditions, any variation, including the introduction of any additional terms and conditions, to the Contract shall only be binding when agreed in writing and signed by Rewarding Visits.

  • Governing law and jurisdiction: This Contract is governed by English law and you can bring legal proceedings in respect of this Contract, its subject matter or formation (including non-contractual disputes or claims) in the English courts. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
